{"id":2006,"date":"2026-01-20T11:16:24","date_gmt":"2026-01-20T14:16:24","guid":{"rendered":"https:\/\/serajusticiarevista.com\/?p=2006"},"modified":"2026-01-20T11:16:24","modified_gmt":"2026-01-20T14:16:24","slug":"entre-rios-confirmaron-la-condena-por-desmonte-ilegal-en-un-area-protegida","status":"publish","type":"post","link":"https:\/\/serajusticiarevista.com\/index.php\/entre-rios-confirmaron-la-condena-por-desmonte-ilegal-en-un-area-protegida\/","title":{"rendered":"Entre R\u00edos: confirmaron la condena por desmonte ilegal en un \u00e1rea protegida"},"content":{"rendered":"<p align=\"justify\"><span style=\"font-family: Arial, sans-serif;\">La Justicia confirm\u00f3 la condena por <strong>desmonte ilegal<\/strong> realizado en la zona del <strong>arroyo Perucho Verna<\/strong>, en el departamento Col\u00f3n, Entre R\u00edos, en un fallo que ratifica la responsabilidad penal y ambiental por la afectaci\u00f3n de un \u00e1rea protegida y de alto valor ecol\u00f3gico.<\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial, sans-serif;\">La resoluci\u00f3n emitida por el Superior Tribunal de Justicia (STJ) de esa provincia dej\u00f3 firme la sentencia dictada en primera instancia contra los responsables del desmonte, al considerar acreditado que las tareas de tala y remoci\u00f3n de vegetaci\u00f3n nativa se llevaron a cabo sin autorizaci\u00f3n y en violaci\u00f3n a la normativa ambiental vigente. <\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial, sans-serif;\">Seg\u00fan se estableci\u00f3 durante el proceso, las intervenciones provocaron un <strong>impacto directo sobre el ecosistema del arroyo y su entorno<\/strong>, alterando el equilibrio natural y afectando recursos h\u00eddricos.<\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial, sans-serif;\">En su decisi\u00f3n, el tribunal destac\u00f3 la importancia de proteger los bosques nativos y los cursos de agua, y subray\u00f3 que este tipo de pr\u00e1cticas ilegales generan da\u00f1os ambientales muchas veces irreversibles. Adem\u00e1s, remarc\u00f3 que la legislaci\u00f3n provincial y nacional impone l\u00edmites claros a las actividades productivas cuando estas comprometen el patrimonio natural.<\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial, sans-serif;\">El caso del arroyo Perucho Verna se convirti\u00f3 en un antecedente relevante en materia de delitos ambientales, al reafirmar que el desmonte sin habilitaci\u00f3n constituye una conducta sancionable y que el cuidado del ambiente es una responsabilidad colectiva.<\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial, sans-serif;\">Desde \u00e1mbitos ambientales valoraron la confirmaci\u00f3n de la condena como una se\u00f1al positiva para el fortalecimiento de las pol\u00edticas de protecci\u00f3n del monte nativo y el cumplimiento efectivo de la ley, al tiempo que reiteraron la necesidad de intensificar los controles para prevenir nuevas infracciones.<\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial, sans-serif;\">El fallo, firmado por los magistrados <strong>Gisela Schumacher<\/strong>, <strong>Marcelo Marchesi<\/strong> y <strong>Adriana Acevedo<\/strong>, confirm\u00f3 la sentencia dictada en la causa ACAPS c\/ Rossier Francisco y otros&#8221;, promovida por la ONG &#8220;Asociaci\u00f3n Civil Arroyo Perucho Salvaje&#8221;
